Offer Agreement

1.1. Public offer (hereinafter - the Offer) - a public proposal of the Seller, addressed to an indefinite circle of persons, to conclude a Service Agreement with the Seller by remote means (hereinafter - the 'Agreement') on the terms contained in this Offer, including all Appendices.

1.2. Order - the Customer's decision to order the Data Processing Service through the website https://durevpn.com/, https://durev.cloud/ by selecting one of the tariffs and paying for it, is a full and unconditional acceptance of this Offer by the Customer.

1.3. The Seller provides Data Processing Services, including private virtual access services, as well as other Services related to private Internet security and private Internet access (hereinafter - Services). Services include, but are not limited to, VPN and other software, add-ons, applications, information, and informational materials available to the Customer from the Seller.

1.4. Tariffs - a system of prices for Data Processing Services, presented on the website https://durevpn.com/, https://durev.cloud/.

2.1. The Buyer places an Order for Data Processing Services through the website https://durevpn.com/, https://durev.cloud/ by selecting one of the tariffs presented on the website. By paying for the Order, the Buyer confirms agreement to conclude this Agreement (acceptance of the offer).

2.2. By concluding the Agreement, the Buyer confirms the following:

• a) The Buyer is fully acquainted with and agrees to the terms of this Agreement;
• b) The Buyer gives permission for the collection, processing, and transfer of personal data on the terms defined in the Personal Data Processing Policy, posted on the website https://durevpn.com/, https://durev.cloud/.

3.1. The price for Data Processing Services is indicated on the website https://durevpn.com/, https://durev.cloud/ in the Tariffs section.

3.2. The Seller has the right to unilaterally change the price for any Tariff.

3.3. The Seller is not allowed to change the price for a paid Order.

3.4. The Buyer's obligations to pay for the Order are considered fulfilled from the moment the Seller receives funds in accordance with the Tariffs in full.

3.5. Payments between the Seller and the Buyer for the Product are made by the methods specified on the website https://durevpn.com/, https://durev.cloud/.

4.1. The order for Services is placed by the Buyer through the website https://durevpn.com/, https://durev.cloud/ or by issuing an invoice for payment to the client's email.

4.2. When ordering on the website https://durevpn.com/, https://durev.cloud/, the Buyer is obliged to provide an email address.

4.3. If the Seller needs additional information, they have the right to request it from the Buyer. In case the Buyer does not provide the necessary information, the Seller is not responsible for providing a quality service to the Buyer.

4.4. The Buyer is responsible for the accuracy of the information provided when placing and paying for the Order.

4.5. The Agreement between the Seller and the Buyer is considered concluded from the moment of electronic order placement on the website https://durevpn.com/, https://durev.cloud/ and its payment by the Buyer.

6.1. The Buyer has the right to refuse Services at any time during the Agreement, funds paid in accordance with the Tariffs are non-refundable. You can read the full refund policy here.

6.2. If the Buyer has not contacted the Seller in writing at the addresses specified on the website https://durevpn.com/, https://durev.cloud/ with a proposal to terminate the Agreement, the Agreement is considered valid until its termination by mutual agreement of the Parties.

6.3. The Seller has the right to restrict the provision of Services to the Buyer in case of detection of unfair use of the Service, namely:

• a) Use of the Service by the Buyer for the purpose of violating the legislation of the Russian Federation or other states;
• b) Transfer of the individual access key to third parties (except for close relatives of the Buyer);
• c) Exceeding the quota for used traffic in the amount of 3 terabytes per 30 days. If this threshold is exceeded, access to the Service will be automatically suspended. In this case, the Buyer can contact the Seller using any available communication channels and request an increase in the traffic limit. The Seller is obliged to increase the traffic limit for the Buyer up to 5 terabytes per 30 days in response to such a request from the Buyer, but not more than once every 30 days.

7.1. The Buyer undertakes not to use the system for spam, port scanning and proxies, mass mailing (even if the letters are actually sent through another server), not to commit hacker attacks on other computers or networks.

7.2. The coverage area, internet speed, and connection quality when providing Services may vary. The Seller undertakes to do everything possible to ensure that the Services are provided at any time (except for maintenance and repair breaks). Services may be unavailable due to factors beyond the Seller's control, including emergencies, network problems or restrictions, interference, signal interruption, malfunctions of other services.

7.3. The Seller is not responsible for the loss of data and messages, incorrect display of pages due to network problems (for example, on the T-1 line). To protect Buyers, the Seller may unilaterally impose restrictions on the use of certain data and block customer service. Network speed is a nominal estimated characteristic and does not correspond to the actual speed of sending and receiving data. The actual network speed depends on its configuration, data compression method, network load, and other factors. The Seller does not give guarantees regarding the timeliness of data receipt and is not responsible for possible delays or losses.

8.1. Within the basic subscription plan, the User is granted access to the Service's server directions under the terms set out in this Offer.

8.2. In order to ensure service stability, balanced load distribution, and maintain access quality, the Contractor may set specific rules for using certain server directions, including traffic limits for individual server categories.

8.3. For servers with whitelist bypass under the basic subscription plan, a traffic limit of 70 (seventy) GB per calendar month per User is established.

8.4. For servers in the Roblox Gemini category under the basic subscription plan, a traffic limit of 40 (forty) GB per calendar month per User is established.

8.5. For other servers not specified in clauses 8.3-8.4 of this Offer, traffic is provided without volume limitation unless otherwise provided by the tariff, service description, or separate service usage rules.

8.6. Upon reaching the established traffic limit for the relevant server category, the User may purchase additional traffic volume under the terms in effect at the time of purchase.

8.7. Upon reaching the established limit, access to the relevant server category may be restricted until the start of the next billing period or until the User purchases additional traffic volume.
